Terms and conditions

On completion of this registration document you will be deemed to have accepted both the terms and conditions of registration as well as to abide by the Rules and Regulations of the Benoni Northerns Cricket Club.

1. Responsibility and risk

All members, players, parents, coaches, team managers and any other visitors to the club accept responsibility and risk to their own person or personal property – this includes: loss of life or limb; damage to vehicles; theft of vehicles or cellphones and theft of other personal belongings.

All club activities are undertaken at my own risk or at my child’s own risk.

Benoni Northerns Cricket Club and Benoni Northerns Sports Club are hereby indemnified against any and all claims arising from these specific and any other related activities.

2. Medical information

Although medical information is requested on this form, no undertakings are made to anyone that such information will be used appropriately or at all. It is requested for the purpose of attempting to assist in the event of a medical condition arising.

3. Undertakings

The following undertakings are hereby made:

To pay all monies when they become due. In the event of any special financial circumstances arising, arrangements must be made with the Chairman of Benoni Northerns Cricket Club.
To abide by the current rules of the Easterns Cricket Union “ECU”.
To play for the entire season.
There is no medical, legal or other condition which may have any bearing on the player’s membership of the club or engaging in the club’s activities.
To read, from time to time, the notices on the official club website (www.bnsc.co.za) so as to stay abreast of the club’s affairs/notices/policies.

4. Conflicts

Conflicts In the event of a conflict arising within the team, with coaches and/or officials, between parents, with opposition, with spectators, or in any other way and such conflict cannot be resolved effectively, promptly and appropriately, written representation can be made to:

Documents can be hand-delivered to the office at the club between 09h00 and 14h00 week days. All players, coaches, officials and parents/guardians are subject to the disciplinary code of the club.

5. Access to games and practices

The right of admission is reserved at all venues where teams have fixtures.

No access is permitted to non-players and non-officials within the practice enclosure at any time during training sessions.

Agreement between user and Benoni Northerns Cricket Club

The Benoni Northerns Cricket Club Web Site is comprised of various Web pages operated by Benoni Northerns Cricket Club.

The Benoni Northerns Cricket Club Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Benoni Northerns Cricket Club Web Site constitutes your agreement to all such terms, conditions, and notices.

Modification of these Terms of Use

Benoni Northerns Cricket Club reserves the right to change the terms, conditions, and notices under which the Benoni Northerns Cricket Club Web Site is offered, including but not limited to the charges associated with the use of the Benoni Northerns Cricket Club Web Site.

No unlawful or prohibited use

As a condition of your use of the Benoni Northerns Cricket Club Web Site, you warrant to Benoni Northerns Cricket Club that you will not use the Benoni Northerns Cricket Club Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. Benoni Northerns Cricket Club has no obligation to monitor the Communication Services. However, Benoni Northerns Cricket Club reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Benoni Northerns Cricket Club reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Benoni Northerns Cricket Club reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Benoni Northerns Cricket Club’s sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. Benoni Northerns Cricket Club does not control or endorse the content, messages or information found in any Communication Service and, therefore, Benoni Northerns Cricket Club specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Termination/Access restriction

Benoni Northerns Cricket Club reserves the right, in its sole discretion, to terminate your access to the Benoni Northerns Cricket Club Web Site and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in San Mateo County, California, U.S.A. in all disputes arising out of or relating to the use of the Benoni Northerns Cricket Club Web Site. Use of the Benoni Northerns Cricket Club Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent an d subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.
